Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Mailhogs platform ("Service") operated by Mailhogs ("we", "our", or "us"). By creating an account or using the Service, you agree to be bound by these Terms.

1. Eligibility
You must be at least 18 years old and able to form a legally binding agreement to use Mailhogs. By using the Service, you represent that you meet these requirements. If you are using Mailhogs on behalf of a business, you represent that you have the authority to bind that business to these Terms.
2. Account Responsibility
You are responsible for maintaining the security of your account, including any connected Google account or OAuth credentials. You are responsible for all activity that occurs under your account.
Notify us immediately at legal@mailhogs.com if you believe your account has been compromised.
3. Acceptable Use
You agree not to use Mailhogs to:
- Send unsolicited commercial email (spam) in violation of applicable law, including the CAN-SPAM Act, CASL, GDPR, or any other applicable anti-spam regulations.
- Send email to recipients who have opted out or requested not to be contacted.
- Harass, threaten, defraud, or deceive recipients or any other person.
- Send phishing emails, malware, or any content designed to harm recipients.
- Impersonate any person or entity, or misrepresent your affiliation with a person or entity.
- Use the Service in any way that violates applicable law or regulation.
- Attempt to gain unauthorized access to the Service or its underlying systems.
- Use the Service to process sensitive personal data, such as health records, financial data, or government ID numbers, without appropriate safeguards.
- Reverse engineer, decompile, or otherwise attempt to derive the source code of the Service.
4. Email Compliance
You are solely responsible for ensuring that all campaigns, recipient lists, and email content comply with applicable laws and regulations in your jurisdiction and the jurisdictions of your recipients. This includes, but is not limited to:
- Including a valid physical postal address in commercial emails where required.
- Honoring opt-out or unsubscribe requests promptly.
- Only emailing recipients who have given lawful consent where required by law.
- Ensuring your email content is truthful and not deceptive.
Mailhogs provides tools to assist with outreach but does not review your campaigns or recipient lists for legal compliance. You bear full responsibility for your use of the platform with respect to email law.
5. AI-Generated Content
Mailhogs uses AI to draft emails, classify replies, and generate other content on your behalf. AI-generated content may contain inaccuracies, errors, or language that is not appropriate for your use case. You are responsible for reviewing AI-generated content before sending it to recipients and for ensuring it meets your standards for accuracy, professionalism, and compliance.
6. Google Integration
Mailhogs integrates with Google APIs, including Gmail and Google Calendar. By connecting your Google account, you authorize Mailhogs to act on your behalf within the permissions you grant. You can revoke this access at any time from your project settings or directly from your Google account settings.
Your use of Google services through Mailhogs is also subject to Google's Terms of Service.
7. Service Availability
We aim to provide a reliable service, but we do not guarantee that Mailhogs will be available at all times, error-free, or uninterrupted. The Service is provided "as is" and "as available" without warranty of any kind, express or implied.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice. We will make reasonable efforts to notify users of significant changes.
8. Fees and Billing
Access to certain features of Mailhogs may require a paid subscription. Subscription pricing, billing cycles, and payment terms will be presented to you before any charges are incurred. Fees are non-refundable except as required by applicable law or as described in a separate refund policy.
We reserve the right to change pricing with reasonable notice to active subscribers.
Note: If Mailhogs does not currently have active billing, this section serves as a placeholder for when billing is introduced.
9. Termination and Suspension
You may stop using Mailhogs and close your account at any time by contacting us at legal@mailhogs.com.
We reserve the right to suspend or terminate your account at any time if we believe you have violated these Terms, engaged in abusive or illegal activity, or pose a risk to the Service or other users. We will make reasonable efforts to notify you before or promptly after taking such action.
Upon termination, your right to use the Service ends. Sections of these Terms that by their nature should survive termination will continue to apply.
10. Intellectual Property
Mailhogs and its underlying technology, design, and content are owned by us or our licensors. Nothing in these Terms transfers ownership of any intellectual property to you.
You retain ownership of your own data, content, leads, and campaigns. By using the Service, you grant us a limited license to process and store your content as necessary to provide the Service.
11. Feedback
If you share feedback, ideas, or suggestions with us, you agree that we may use them without obligation to you, including without compensation or attribution.
12. Limitation of Liability
To the maximum extent permitted by applicable law, Mailhogs and its affiliates, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, lost data, or business interruption, arising out of or in connection with your use of the Service.
Our total liability to you for any claim arising out of these Terms or your use of the Service will not exceed the greater of (a) the amount you paid us in the twelve months prior to the claim, or (b) one hundred US dollars ($100).
13. Indemnification
You agree to indemnify, defend, and hold harmless Mailhogs and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your violation of these Terms, your violation of any applicable law, or your campaigns or email content.
14. Governing Law
These Terms are governed by the laws of the state of Florida, United States, without regard to conflict of law principles. Any disputes will be resolved in the courts located in Florida, and you consent to personal jurisdiction in those courts.
15. Changes to These Terms
We may update these Terms from time to time. When we do, we will update the effective date at the top of this page. For material changes, we will make reasonable efforts to notify you in advance. Your continued use of the Service after updated Terms take effect constitutes your acceptance.
